Terms of Use
How you may use the Nutae application.
1. Purpose and acceptance of the Terms
These Terms of Use ("Terms") govern access to and use of the Nutae mobile application ("the App"), published by SmartZonesIndicators, a French company. "Use of the App implies full and unreserved acceptance of these Terms."
Acceptance is materialized at signup by ticking a dedicated box preceded by the statement "I accept the Terms of Use". It is timestamped and recorded by the Publisher. Without acceptance, Account creation and access to the Service are not possible.
The Publisher may modify these Terms at any time. Any substantial change is notified via the App or by email at least 30 days before entry into force.
2. Service description
2.1 Nature of the application
Nutae is a food and digestive symptom diary intended for adults wishing to keep a food log and observe their digestive symptoms, particularly in the context of recurrent digestive discomfort (Irritable Bowel Syndrome). The App computes exploratory statistical associations between food intake and symptoms to surface likely triggers.
2.2 Medical disclaimer
Statistical associations, suggestions and content shown by the App are provided for purely informative and indicative purposes. The User undertakes not to make any decision regarding diet, treatment or health based solely on information provided by the App.
3. Access conditions and capacity
3.1 Minimum age
The App is strictly reserved for individuals "aged at least 16". Subscribing to a Premium subscription further requires legal majority ("18 years old") for contractual capacity.
3.2 Unsuitable audiences
Use of the App, and in particular of any temporary elimination protocol, is "not recommended without prior medical advice" for individuals:
- presenting or having presented an eating disorder (anorexia, bulimia, binge eating, orthorexia)
- in a state of malnutrition or pathological thinness
- pregnant or breastfeeding
- under ongoing medical treatment (immunosuppressant, corticosteroid, oncology, psychiatric, IBD)
- suffering from an unexplored or unstabilized organic digestive condition
- presenting warning signs (unexplained weight loss, blood in stool, persistent fever, anemia)
These audiences are invited to consult a doctor or registered dietitian before any use of the Service. Continued use in disregard of these warnings constitutes use not compliant with the intended purpose of the Service, within the meaning of Section 10.
4. User account
Use of the App requires creating an Account (email + password, or federated sign-in via Apple or Google). The User is responsible for the confidentiality of their credentials and for any activity carried out from their Account.
The User may delete their Account at any time from the Profile screen. Deletion wipes all data (diary, symptoms, correlations) within 30 days, with no recovery option.
6. AI disclaimer
AI features (notably "Ask Nutae" which analyzes a meal photo) rely on general-purpose generative models (Google Vertex AI Gemini) not certified for medical purposes. Suggestions produced are "purely indicative, exploratory and probabilistic".
The User is the "sole judge" of the relevance of suggestions and must "validate each suggestion" against their allergies, intolerances, food preferences and health status before saving. The Publisher disclaims any liability regarding the User's interpretation of AI results, subject to Section 10.
The User has a right to human intervention and to contest AI results, exercisable by email to dpo@smart-zones-indicators.com.
7. Intellectual property
The App, its code, design, enriched FODMAP database and statistical correlation algorithm are the exclusive property of SmartZonesIndicators, protected by French and international laws. "Any reproduction, modification or reverse engineering is strictly prohibited."
The User benefits from a personal, non-exclusive, non-assignable and non-transferable license to use. Data the User enters (meals, symptoms, notes) remains their property; they grant the Publisher a limited license to process it solely for operating the Service.
8. User obligations
The User undertakes to use the App in accordance with its purpose, to respect intellectual property, not to bypass security measures, not to reproduce content for commercial use, and to provide accurate information when creating the Account. Any breach may result in immediate Account suspension.
9. Availability and force majeure
The Publisher strives to ensure Service availability 24/7. Access may nonetheless be interrupted for maintenance, updates, force majeure or third-party infrastructure failures (Apple, Google, Firebase). "The Publisher reserves the right to modify, suspend or interrupt all or part of the services" without notice.
The Publisher is not liable in case of force majeure: natural disasters, fires, pandemics, terrorism, wars, technical failures or cyberattacks beyond its reasonable control.
10. Limitation of liability
The App is provided "as is". SmartZonesIndicators cannot be held liable for any symptom worsening, inappropriate dietary choice, diagnostic delay or medical decision resulting from use of the App. The App is a self-observation tool, not a substitute for medical follow-up.
"The Publisher's total liability towards the User shall not exceed the amount actually paid" over the last twelve (12) months for the Premium subscription (or fifty euros if none). This limitation does not apply in case of gross negligence, wilful misconduct, bodily injury, nor to the consumer's mandatory rights.
11. Personal data
Processing of personal data, in particular "health data" within the meaning of Article 9 GDPR, is governed by the Privacy Policy, accessible from the App and at https://www.nutae.app/en/legal/privacy. Processing is based on the User's granular explicit consent, collected at signup and revocable at any time.
12. Modification, governing law and contact
These Terms are governed by French law. Any dispute falls under the exclusive jurisdiction of the Paris courts, after attempting amicable settlement. Under the French Consumer Code, the consumer may freely resort to an approved consumer mediator.
If any clause is declared invalid, the others retain full validity.
