Sales Terms
Purchase and Nutae Premium subscription conditions.
1. Preamble
These Sales Terms ("Sales Terms") govern Nutae Premium subscriptions provided by SmartZonesIndicators via the Nutae application. "Any subscription implies unreserved acceptance of these Sales Terms."
Premium subscriptions are distributed via the Apple App Store (iOS) and Google Play Store (Android). Apple and Google act as "Merchants of Record": they collect payment, issue the invoice and manage refunds. SmartZonesIndicators has no access to any banking information of the User.
2. Premium offerings
2.1 Free tier
Access to the food diary, symptom tracking, French FODMAP database, and descriptive statistics. Correlation analysis and the elimination protocol are reserved for the Premium tier. No payment required.

Prices are shown including all taxes (French VAT 20% included). Prices may vary by currency and region — refer to the App Store / Google Play listing for your country.
3. Free trial period
Any new Premium subscription (monthly or yearly) includes a "14 consecutive day free trial". The free trial can only be used once per Apple ID or Google Account.
"If the User does not cancel at least 24 hours before the end of the trial, the subscription will automatically convert to paid" and the corresponding amount will be charged by the store (Apple or Google).
4. Payment method
Payment is processed via the store platform (App Store or Google Play) using the payment method on the User's account. "SmartZonesIndicators has no access to any banking information."
5. Auto-renewal and French Chatel Law
The Premium subscription auto-renews at the end of each period: monthly for the monthly plan, yearly for the yearly plan. Renewal is managed by Apple or Google and charged to the registered payment method.
For the yearly plan, pursuant to Article L.215-1 of the French Consumer Code (Chatel Law), the Publisher sends a "dedicated email 1 to 3 months before renewal" to inform the User of the option not to renew.
6. Cancellation by the user
The User may cancel their subscription at any time from their App Store or Google Play account settings, free of charge and without justification:
- iOS: Settings > Apple ID > Subscriptions (https://apps.apple.com/account/subscriptions)
- Android: Play Store > Profile > Payments & subscriptions (https://play.google.com/store/account/subscriptions)
Cancellation takes effect at the end of the current period. The User retains Premium access until that date.
7. Right of withdrawal
Pursuant to Article L.221-28 1° of the French Consumer Code, "the right of withdrawal does not apply to contracts for the supply of digital content not supplied on a tangible medium whose performance has begun after the consumer's express agreement".
"By activating the free trial or confirming the paid subscription, the User expressly waives their right of withdrawal." This waiver is collected at subscription time via a dedicated checkbox, separate from acceptance of the Sales Terms.
8. Refunds
"No pro-rata refund" is issued for cancellation within a period. The applicable refund policy is that of the stores (Apple App Store or Google Play), accessible directly from the User's account.
9. Legal warranty of conformity
Nutae Premium is a "continuous digital service" within the meaning of Article L.224-25-1 of the French Consumer Code. The legal warranty of conformity is owed by the Publisher throughout the contract duration. The User may report any non-conformity to support@smart-zones-indicators.com.
10. Family Sharing, AI and medical disclaimer
For version 1.0, "Apple Family Sharing is NOT eligible" for Nutae Premium. Each household member must subscribe individually.
The Publisher's total liability towards the User shall not exceed the amount actually paid over the last twelve (12) months (fifty euros if none), excluding gross negligence, wilful misconduct, bodily injury and the consumer's mandatory rights.
11. Mediation, governing law and customer support
In case of dispute, the consumer User may freely resort to an approved consumer mediator. A European online dispute resolution platform is also available: https://ec.europa.eu/consumers/odr.
These Sales Terms are governed by French law. Any dispute falls under the exclusive jurisdiction of the Paris courts, subject to mandatory rules of consumer jurisdiction.
